Terms and Conditions

These terms and conditions apply to the use of AI Act Scanner, offered by Bijstra AI & Engineering Consultancy.

1. Service Provider

2. Definitions

  • โ€ข'Service' โ€” the AI Act Scanner available at aiactscanner.com
  • โ€ข'User' โ€” any natural or legal person using the Service
  • โ€ข'Scan' โ€” the automated checking of a website for AI Act compliance
  • โ€ข'Report' โ€” the result of a Scan, including score and recommendations
  • โ€ข'API' โ€” the programmatic interface for automated access to the Service

3. The Service

AI Act Scanner provides automated website scans that detect AI usage and assess compliance with the EU AI Act. Results are informational and do not constitute legal advice.

4. No Legal Advice

The Service is purely informational. Scan results and reports are indicative and do not replace legal advice. We recommend consulting a specialised advisor for binding compliance assessments.

5. Pricing and Payment

Prices are one-time and include VAT. Payment is processed via Mollie (iDEAL, credit card). After payment, the scan starts immediately. Free scans are limited to 2 per month per IP address.

6. Right of Withdrawal

Digital services are delivered immediately after payment. By starting a paid scan, you consent to immediate delivery and waive your right of withdrawal in accordance with Article 6:230p(1)(d) of the Dutch Civil Code.

7. Liability

We endeavour to provide accurate scan results but do not guarantee complete or error-free detection. Our liability is limited to the amount you paid for the relevant scan.

8. Intellectual Property

All intellectual property rights to the Service, software and reports belong to Bijstra AI & Engineering Consultancy. Reports may be used for your own purposes.

9. Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates or technical issues.

10. API Usage

API access is subject to these terms. API keys are personal and may not be shared or resold. Misuse, excessive usage or automated access beyond the permitted quota may result in suspension.

11. Suspension and Termination

We reserve the right to suspend or terminate accounts in case of suspected misuse, fraud or violation of these terms. In case of suspension, we will notify you by email.

12. Force Majeure

We are not liable for failures resulting from force majeure, including outages at third parties (Cloudflare, Mollie, Mistral AI), internet issues, power failures or government measures.

13. Privacy

We process personal data in accordance with our Privacy Policy. By using the Service, you consent to this processing.

14. Changes

We reserve the right to modify these terms. The most recent version is always available on this page.

15. Complaints and Disputes

For complaints, please contact us at info@aiactscanner.com. The European ODR platform for online dispute resolution is available at ec.europa.eu/consumers/odr.

16. Applicable Law

These terms are governed by Dutch law. Disputes shall be submitted to the competent court in Leeuwarden, the Netherlands.
