AI chatbots: what do you need to disclose?

If you have an AI chatbot on your website, visitors must know they're talking to a computer. This is one of the most common AI Act obligations for webshops — and luckily one of the easiest to fix.

The AI Act (Article 50(1)) requires users to be informed when they interact with an AI system. This applies to any chatbot that uses AI to generate replies.

Important: not every chatbot is AI. A chatbot with fixed answers (decision tree) is out of scope. But as soon as the chatbot generates, phrases or summarises answers with AI, the obligation kicks in.

What should you do? Show a clear notice before the user starts chatting. For example: 'You're chatting with our AI assistant. For personal advice, please contact our customer service team.'

The notice must be accessible: sufficient contrast, readable by screen readers (ARIA labels) and visible before the conversation begins.
