Explaining recommendations and personalisation
Does your webshop show 'recommended products' or 'others also bought'? The AI Act and the Digital Services Act both require you to explain how these systems work.
Recommender systems fall under the transparency obligations of the AI Act (Article 50) and the Digital Services Act (Article 27). Both laws require an explanation of how recommendations are produced.
You must describe which factors are taken into account: purchase history, browsing behaviour, popularity, location, etc. This can be in your terms or privacy policy, but also directly next to the recommendations.
The DSA additionally requires that users get options to influence recommendations. Think of a setting to switch off personalisation, or to choose recommendations based on popularity instead of personal behaviour.
Practical: add a small information note next to your recommendations and link to an explanation page with more detail on how the system works.
